Criminal Law
Criminal law, the subject of which is crimes and penalties, has imposed sanctions on those who do not comply with the state to give orders to individuals to perform or avoid certain behaviors in order to maintain social order and protect individual interests. In this context, criminal law examines these laws and orders and sanctions.
Criminal law has two basic functions; the first is the function of punishing in case of a crime, that is, the punitive function, and the second is the function of protecting society during this punishment function.
According to the Turkish Penal Code No. 5237, the purposes of the criminal law are to protect individual rights and freedoms, to protect public order and security, to protect the rule of law, public health and the environment, to protect social peace, and to prevent crimes.
The most fundamental principle adopted in criminal law is the principle of legality. Accordingly, an act not specified in the law will not constitute a crime, and only the penalty specified in the law can be applied to the crime. Thus, the judge’s authority to consider actions as crimes and to punish them is limited and arbitrariness is prevented. On the other hand, individuals are given the opportunity to learn in advance which actions constitute crimes and to act accordingly.
Another principle that is fundamental to criminal law is the principle that there is no perfect crime or punishment. Fault constitutes the reason and limit of punishment. Accordingly, there will be no objective responsibility in criminal law, the personality and past of the perpetrator will not be important in determining responsibility for the act, but will play a role in individualizing the punishment. Therefore, contemporary criminal law is not the perpetrator, but the criminal law of the act.
